An “interview” that Michelle Obama had with the API, admonishing them for “siding with racist bloggers” and ranting against them for questioning her husband, had one interesting little tidbit in it….
“African Press International is supposed to support Africans and African-American view,” she reportedly said. “It is strange that API has chosen to support the racists against my husband. There is no shame in being adopted by a stepfather. All dirt has been thrown onto my husband’s face and yet he loves this country. My husband and I know that there is no law that will stop him from becoming the president, just because some American white racists are bringing up the issue of my husband’s adoption by his stepfather. The important thing here is where my husband’s heart is at the moment. I can tell the American people that my husband loves this country and his adoption never changed his love for this country. He was born in Hawaii, yes, and that gives him all the right to be an American citizen even though he was adopted by a foreigner.”
There are a few things that I don’t know…
1. I don’t know if the adoption by Lolo Soetoro results in automatic Indonesian citizenship. Under US law, adoption of a foreign child by a US citizen does not automatically result in citizenship being granted, it has to be requested, but the request is automatically approved. If anyone knows Indonesian law regarding this subject, I would like to know more. No theories. I want sources.
2. I don’t know if Obama ever had Indonesian citizenship (either by request or automatically)
3. I don’t know how Indonesian law feels about dual or tri citizenship. If Obama was granted Indonesian citizenship, does Indonesian law require that you reject all other citizenships? If anyone knows Indonesian law regarding this subject, I would like to know more. No theories. I want sources.
4. I don’t know if Obama did give up his US citizenship, how his re-naturalization would affect his classification as a “natural born citizen.”
5. I don’t know why Obama has not been honest about his life. He has lied about virtually everything about his origins… from the Kennedy Airlift, to Selma, to the marriage of his parents, to his citizenship of Kenya to his concentration camp liberating uncle.
So here are the things I know…
1. I KNOW that Obama has now admitted that he was a Kenyan citizen through his father.
2. I KNOW that Obama has been hiding all sorts of things and only begrudginly admitting anything about himself when irrefutable proof is discovered.
3. I KNOW that the SCOTUS has never had a case they decided on the status of a person that held possibly three nationalities as a child and the qualification of “natural born citizen” as a qualification for the Presidency.
4. I KNOW that the SCOTUS has never decided a case on the status of a person that gave up his citizenship to the US when adopted by a foreigner, but was renaturalized a few years later.
5. I KNOW that I don’t want a President that lies and tries to cover up who he is and where he came from.

This argument is silly.
Birthright citizenship in the United States of America follows from a hybrid rule of jus soli and jus sanguinis. Under the American system, any person born within the United States (including the overseas territories of Puerto Rico, Guam, the U.S. Virgin Islands, and the Northern Mariana Islands) and subject to its jurisdiction is automatically granted U.S. citizenship, [1] as are many (though not all) children born to American citizens overseas.
When accorded automatic birthright citizenship based on birth on American soil, a newborn’s status is generally unaffected by the legal status or citizenship of that individual’s mother or father.

I am aware of the argument you set forth, but what happens if that person gives up their citizenship in exchange for another one, even for a short time, especially considering the fact that a person that does this has to re-apply for citizenship and it is no longer automatically granted.
How would that affect his status as a “natural born citizen” and qualifications for the Presidency?
The answer: We dont know because SCOTUS has never made a decision on this subject.
Even if he was born in America…( which he wasn’t )….
Indonesia doesn’t allow “duel” citizenships and the would have had to relinquish his American one. This was a requirement for him to go to school there, which is a fact.
Then….he would have had to become “naturalized” as in the Ellis Island way…..to run for office in America.
He still couldn’t run for President…..Naturalized and Natural Born Citizens are NOT the same thing.
It doesn’t affect his citizenship. This is a hoax. They pulled the same garbage on McCain (Panama) and Goldwater (Arizona before statehood).
Obama was born in Hawaii in 1961. Hawaii became a state in 1959. Therefore he’s a “natural born citizen”
Strictly academically speaking.. the Constitution doesn’t exactly state what “natural born citizen” means.
In my opinion.. His mother was a US Citizen…he was born in the US. Case closed.

I just got off the phone with a very reputable source that says there is absolutely, positively an audiotape showing that Michelle Obama did in fact say what she said.
I cannot say more right now, as to the source, but let’s put it this way — If you want to know something about Obama, you talk to this guy.

It seems like any of us could at least contact the Secy. of State in our state and ask him/her how they verified the eligibility of Obama to be on the ballot. What proof do they have??
That’s part of Secy. of State’s job in each state. All it takes is one Secy. of State to say that he/she won’t allow Obama’s name on that state’s ballot without a copy of certificate DIRECTLY from Hawaii Dept. of Health — none of the “go look at a website” stuff.

When one relinquishes his US citizenship, you need to declare your intentions before a US government (i.e.: consular) official. You get a certificate of release of citizenship. You have to pay a fee to process the forms. No fee paid = no forms processed. No forms processed = no citizenship lost.
This is intended to protect citizens that are forced under duress to make such declarations by officials of another country from losing their citizenship. This includes minors who are not yet of the age of majority, to protect their status as US citizens.
THERE WAS A TIME when the US forced people from other countries to renounce their citizenships when becoming US citizens. This eventually wound its way thru the Courts, where it was ruled unconstitutional. Other countries took up the tactic of not recognizing any renunciation without a home-government official present and a processing fee paid, and the US followed suit to protect its citizens too.

I think the adoption argument is a loser. I do not know of any principle of law that automatically strips someone of US citizenship just because they are adopted by a foreign national. Besides, his mother remains and always was a US citizen, so even if his citizenship status depended upon his parents (which it does not, as another poster has said), then he would still retain his US citizen status.
PS: I’m a Clintonite, but I just don’t think this works.

Tom Richmond is right – U.S. citizenship can only be relinquished expressly before a U.S. consular official. The mere fact that Indonesian law does not allow dual nationality does not mean that Obama IN FACT lost his U.S. citizenship through adoption.
Indonesian law did not allow dual nationality when Obama lived there. If Obama was officially adopted by his stepfather Lolo Soetoro, this means one of two things:
(1) Obama’s stepfather and mother lied to the Indonesian government, perhaps claiming that Obama had given up his Kenyan and U.S. citizenships. A small bribe would probably have sufficed to deal with any official problems.
(2) Obama’s mother IN FACT relinquished her and Obama’s U.S. citizenshp before the U.S. Consulate/Embassy in Indonesia.
This is unlikely – Indonesia was a young and unstable country, and Lolo Soetoro probably appreciated the option of returning to the U.S. in the event of further problems in Indonesia. Also, renunciation of U.S. citizenship would have caused problems when Obama returned to Hawaii as a teenager.
On the other hand, Obama’s mother did work for UN agencies and might have benefited from being a citizen of a large “developing” country.
P.S.: What is Michelle trying to achieve?
We know that (1) she is a lawyer; (2) she will have been well briefed by Barry’s (all-white) legal crisis team.
Most likely, Michelle’s comments are attempting to draw attention AWAY from the still-unresolved issue of where Obama was born. Their continued hiding of Obama’s 1961 birth certificate (not the modern re-issue) indicates they are hiding SOMETHING.
Also, Obama’s health remains a MAJOR issue that Michelle wants to distract us from – are we getting another JFK wracked by something like Addison’s disease? Has Barry had cancer? (His mother died when she was five years older than he is now – McCain’s mother is still going strong at 90.) Does Barry take anti-depressants?
Despite “sophisticated” comments to the contrary, it is quite possible that Hillary’s Ivy League trained legal “plumbers” did not drill and snake DEEP ENOUGH into Obama’s personal background and “natural-born” status. If so, expect some interesting developments AFTER the election (e.g. Biden mysteriously dropping out due to illness, to be replaced by HIllary or a temporary place warmer).
On the other hand, one must be alive to the possibility that Michelle and her man are encouraging us to bark up the wrong tree. America is a compassionate country. It is possible that the O-bots will tell us at the last minute (November 2) that poor baby Barry was actually born to a single mom deserted by her man, and we shouldn’t hold his father’s sins against Barry.

Actually if he did not go through immigration when he re-entered the country then he is still an Indonesian citizen…if he went through immigration then he would be considered a naturalized citizen not a natural citizen and would thereby, as stated in the constitution, not be elgible to be president….Attorney Berg has a video out regarding his lawsuit in Philadelphia explaining all of this…but the fact remains he has never produced a birth certificate to the court…and his kenya grandmother says she witnessed his birth along with a half-brother and sister…and because of his mothers age and his father being kenyan..he would not be considered a natural born citizen……..If he has nothing to hide then he needs to provide the documents to the courts.
You people are so ignorant that you take my breath away. A minor child cannot “give up” citizenship. Even if Obama HAD been adopted by his Indonesian stepfather of a few short years, he could have reclaimed his U.S. citizenship at any time, since he was too young to give it up in the first place. ANY CHILD OF A U.S. CITIZEN IS A U.S. CITIZEN, no matter where he or she was born. Only unsophisticated, uneducated people who have never traveled or lived outside of the U.S. could possibly think otherwise. I lived in Europe and knew dozens of children born to American citizens abroad. Those children are ALL legal American citizens, because their parents are citizens.
Moreover, the term “natural-born,” mentioned as a requirement for the presidency in the Constitution, has NEVER been legally defined as referring to birth within U.S. borders. The Constitution does NOT specify this as a definition or requirement for the presidency; it merely says that the President must be a “natural-born” citizen.
So, the only question is whether someone born abroad and who acquired citizenship AT BIRTH by virtue of being born to a U.S. citizen (as all such people do) is a “natural-born” citizen or some other type of citizen. These people are not “naturalized” citizens, since naturalized citizens are born citizens of foreign countries, to parents who are citizens of foreign countries, and take U.S. citizenship later in life. Given that men and women born abroad to U.S, citizen parents are U.S. citizens by law, then what else could they be but “natural-born” citizens?

I think many of you do not have a clue/understanding of what happens to the original birth certificate after an adoption. If Obama was adopted in the United States then he probably doesn’t have access to that bc.
This is partly why the Bastard Nation movement was born. Adult adoptees cannot get their original birth certificate because state law prevents them. Many of these laws were enacted in the 1940s and 19050s to “protect a birth mother/father” privacy. Looking for more info about Barry’s status while living in Indonesia. All he had to do is claim that his school records were wrong, and he gets off scott-free. Why? Why isn’t anyone questioning whether he became an Indonesian citizen? Like you, I’m wondering what Indonesia would have done. Since they did NOT allow dual citizenship at the time, and since the U.S. does not allow parents to renounce a child’s citizenship, then what’s next?

I do know. Under US law it’s impossible for a minor to give up their US citizenship. Even if Obama had wanted to do so he wouldn’t have been allowed to, because he was not yet an adult.

I’m really coming into this late. I have been arguing all these points on another blog for the past two weeks, which led me to this site.

Obama’s father was a foreign national going to school in this country. He had NO allegiance to the U.S. Obama was born a dual citizen — NOT a “natural born” one because he did not have TWO American parents. Through his father, he also owed allegiance to Kenya. An adoption by a Indonesian stepfather would have added a third allegiance on to the two he already had. He would not lose his U.S. citizenship because of the adoption, but it would add more “foreign” influence into the mix. Exactly what the Founders did NOT want in the office of President. The adoption could have also sealed his birth records — even from him!
People will argue that the U.S. vs. Wong case made everybody born on American soil a “natural born” citizen — even children born of illegal aliens. This may apply if the parents have been here for years, working and paying taxes like U.S. citizens, but this does not apply to illegals who only come here to work and then leave again. Their allegiance belongs to their home country and any child they have would only be a Fourteenth Amendment citizen with dual citizenship — like Obama. Even the Wong case says that by “English common law” the parents (plural) had to be under allegiance to England and NOT to any other foreign country. That means they had to be living on English territory as if they were English citizens. That did NOT apply to Obama’s father because he was a “foreign student” and had no intention of making the U.S. his permanent home.
The fact is that this issue will never reach the Supreme Court because the lower courts will never allow it. The fault lies with the Democrat Congress that did NOT vet Obama properly in the first place. It would take actions by Congress to remove him now and the Republicans don’t want to be the fall guy. Nothing will ever be done about having a dual citizenship foreigner for President.
