I am also not making an argument about his eligibility, but it is interesting that instead of just producing the birth certificate that he files a motion to dismiss… and that it has gotten to the point where a court might have to order him to do it.

PS – The federal government has access to each and every birth certificate in this nation. If they had questions, they have already checked the validity of the birth certificate. John McCain’s status was ruled on as being a “natural born citizen” because he was born in the canal zone in Panama, which was considered US soil at the time.

BUT there was a ruling on the subject.

There has been no such ruling on Obama’s dual nationality as a child.

I know the rules of dual nationality, I am a dual national, thank you very much. FACT – he was a dual national as a child and the courts have not ruled on how that effects the qualification status for POTUS.

The only inaccuracy I have put forth is that the order was not yet signed and I corrected myself.

Personally, I think that natural born citizen rule is arcane and should be done away with.

I have also generally said that this is a non-issue, just posted it because it was an interesting piece of news. This is the ONLY piece of news regarding this subject ever discussed here.

Everyone born in America has a birth certificate. If he does not have one then he needs to request one from the state in which he was born. Simple. To get a passport, you have to produce a birth certificate. When I got my passport, all I had was a copy of my birth certificate. I had to send a written request to the state I was born in to get an origional birth certificate that was notorized.

I find it very interesting that he hasn’t already had to show proof of where he was born.

Certification of qualifications of candidates is done in each state by the Secretary of State (or equivalent office). Berg is not Pennsylvania’s Secretary of State.

A case where the facts trump faith. The law doesn’t say that at all (and if it did, it would have disqualified George Washington, among others).

It says nothing at all about the citizenship or residency of one’s parents.

Obama’s qualified under the Constitution. I would argue that McCain is, too — but of course, McCain still hasn’t produced a birth certificate, nor one showing that he was born in the U.S. He was not born in the U.S. Has Berg sued McCain yet?

On that page is also a picture of a Honolulu newspaper birth announcement in 1961 for a son born to Mr. and Mrs. Barack H Obama on August 4. More important is the information in comment #18 at http://texasdarlin.wordpress.com/2008/07/23/obama-was-born-in-hawaii-wrong-can-of-worms/ where an anti-Obama blogger checking it out found that the birth announcements in that paper in 1961 were not submitted by family, but were all based on lists sent to the newspaper from the Department of Vital Records which compiled them from birth certificates they received from local hospitals.

Thus, independent of any photo of a birth certificate is evidence that Barack Obama was born in a Honolulu hospital on August 4, 1961.
